These terms govern the rental of Pocket WiFi Router devices and related accessories from AIVI Amsterdam in Amsterdam. By placing a booking, collecting a device, or using our rental service, you agree to these terms.
1. Rental Contract
A rental contract is formed when we accept your booking and make a device available for pickup or delivery. The booking confirmation, pricing shown at checkout, and these terms form the full agreement between you and AIVI Amsterdam.
You must provide accurate contact and payment details and must be legally able to enter into a binding contract. We may refuse or cancel a booking if the information provided is inaccurate, incomplete, fraudulent, or if the requested rental cannot be fulfilled.
2. Ownership and Permitted Use
All rented Pocket WiFi Router devices, chargers, cables, packaging, and related accessories remain the sole property of AIVI Amsterdam at all times. The rental gives you a temporary right to use the device during the agreed rental period only.
You may not sell, lend, sub-rent, pledge, dismantle, modify, tamper with, unlock, or use the device for unlawful purposes. You are responsible for using the device with reasonable care and in accordance with any instructions we provide.
3. Pickup, Possession, and Return
Your responsibility for the device begins when the device is handed over to you or your representative and continues until we physically receive and inspect the device at return. A return is not complete simply because a device is left at a desk, building, hotel, or third-party location unless we confirm receipt.
You must return the device and all accessories by the agreed date, time, and place. If you expect a delay, you must notify us as soon as possible. Late returns may result in additional rental charges until the device is returned or replaced.
4. Prices, Payment, and Charge Authorization
You agree to pay the rental charges, taxes, and any other clearly disclosed fees shown during booking. By providing a payment method, you authorize AIVI Amsterdam to charge amounts that are due under this agreement, including unpaid rental fees, approved extensions, late return charges, damage charges, cleaning charges if abnormal cleaning is required, and replacement costs if the device or accessories are not returned.
If a payment fails, we may suspend service, require an alternative payment method, cancel the booking, or pursue recovery of amounts owed through lawful means.
5. Damage, Loss, and Theft
You are responsible for loss of, theft of, disappearance of, confiscation of, or physical damage to the rented device and accessories from the moment of handover until confirmed return and inspection by us, except to the extent a loss is directly caused by our own proven failure.
If the device is damaged, you are responsible for the reasonable cost of repair or, if repair is not economical, replacement. If the device is not returned, is stolen, or is returned in a condition that makes it unusable, you are responsible for the full replacement cost of the device and any missing accessories. Missing accessories may be charged separately at their replacement value.
If theft is alleged, you must notify us immediately and, where legally available, file a police report within 24 hours. Providing a police report does not by itself remove your payment responsibility, but it helps us assess the claim and attempt recovery.
6. Service Performance and Network Availability
We aim to provide a working device and clear pickup information. Mobile data performance, coverage, speed, and uninterrupted availability depend on third-party telecom networks, local conditions, congestion, device compatibility, and other external factors outside our direct control.
Unless mandatory law states otherwise, we are not responsible for indirect or consequential losses such as missed business, lost profits, missed travel plans, missed reservations, loss of opportunity, or loss caused by network outages, temporary slow speeds, or third-party platform failures.
7. Limits of Liability
Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or any other liability that the law does not allow us to limit.
Subject to the sentence above, and to the maximum extent permitted by law, our total liability arising out of a rental will be limited to the amount you paid us for that rental booking.
8. Cancellation, Refusal, and Termination
You may request cancellation before pickup. Refund eligibility depends on the timing of cancellation, payment processor fees already incurred, and any non-refundable charges clearly disclosed during booking. Once a device has been collected or handed over, the rental period is considered to have started.
We may cancel or terminate a booking if you materially breach these terms, misuse the device, fail payment, provide false information, or create a fraud or security risk. In such cases, you remain responsible for amounts already due and any loss or damage incurred before return.
9. Privacy and Data Use
We process personal data as described in our Privacy Policy. Booking and rental data may be used to perform the contract, prevent fraud, support customer service, comply with legal obligations, and recover devices or unpaid charges where necessary.
10. Governing Law and Disputes
These terms are governed by the law applicable to the business entity operatingAIVI Amsterdam, except where mandatory consumer protection rules in your country of residence apply and cannot be excluded. Before starting formal proceedings, both parties should first try to resolve disputes through good-faith written communication.
